Recently a neighbor backed into my brand new parked car instead of his driveway. He gave me his insurance info and I reported the claim. It turns out we both have the same insurance companies. I am really upset that a new car (purchased 3 months ago) has sustained damages. What I want to know is what rights do I have in going about a resolution? I know I can get it repaired by a body shop of my choice but I’m not too keen on repairing and then using a car that has been hit through no fault of my own. Repairs are rarely the same as new and I see no reason to be subjected to this as it would eventually cause me loss when I try to sell it. Can I demand to the insurance company to replace my car? I will lose a couple of days in wages in trying to sort this out. Do I have the right to get reimbursed? What about for time lost and inconvenience? Car rental? What other rights do I have? What is the best way to handle this? Please HELP!

Thanks for taking the time to answer my question. I have been in multiple accidents within the past year. I assume that the insurance companies begin to question why I’ve been involved in so many no fault accidents and possibly label me. Thankfully I am still alive and kicking with all my limbs; however the injuries sustained in each accident were very painful and caused a lot of discomfort. Cervical, mid/low back pain, arm numbness, and headaches. I question if the offer I received from Statefarm for $4000.00 when my med bills alone total $7025.00 is because they are aware of the injuries sustained in the previous accidents. Of course I am preparing a counter offer letter, but out all my accidents this is by far the lowest offer I’ve received and totally unacceptable.

Thanks in advance for answering these questions. okay, we were out of town, our 20 yr old daughter let her “friend” drive her vehicle to the store, he was looking down at his cell phone and hit a brick mailbox. We just found out today, the vehicle will be totaled. My question is, assuming our insurance company will deduct the $1000 deductible on the settlement amount, should he be liable for the deductible? Should his insurance kick in to cover this cost? Where is the best place to find the value of our vehicle? it is a 2005 Honda Civic special edition with 24,500 miles and brand new tires. This vehicle was also wrecked 1 1/2 years ago, will that effect the settlement value. Thanks in advance.

Writing from North Carolina. My niece is a 21 year old learner permit driver of a few months. She was traveling with a licensed driver. She rear-ended the car in front (small fender bender), police report filed, insurance information exchanged. A month later, my niece receives notice that she is being sued by the people she hit because the license driver she was with let the insurance lapse. Is my niece liable in the civil suit or should the insurance company go after the license driver? If she is liable, should we get a court appt attorney? Thanxs for any information!

I live in New York and was in a car accident yesterday, Wednesday July 30, 2008 around 8:40 A.M. There were two cars involved in the accident and I had the right of way (no stop sign what so ever) and the other car failed to stop on the stop sign. There was no way he even slowed down on the stop sign because he hit me right on the driver side. Fortunately, nobody was hurt and still consider myself lucky considering the impact of the accident caused my car to swerve 90 degrees, missed a private lawn by zero inches, and missed a parked Lexus car by three to four feet. I was driving an SUV and he was driving the minivan so he had a lower front and did not break any of my windows although the impact caused a serious damage on my doors and caused both my tires at the back to blow. I immediately dialed 911 after the whole incident. The ambulance quickly responded and the police were there minutes after the ambulance came. The EMT asked me if I was feeling okay. I said I was fine but an hour later started feeling some neck pains and headaches. There were a lot of witnesses volunteering to the cops to testify about what happened, but I believe they said it was not necessary. I will definitely find out within 4 days as soon as I get my police report. Since I was still in severe pain two hours later, my sister had volunteered to come home from work and take me to the emergency room. I spent the whole day in the ER trying to get examined and hopefully get some medical advice considering, the pain is probably caused by the whiplash of the accident.
Now here are my questions:
1. Will I be fully covered by the other vehicles insurance considering he failed to stop at the stop sign and I had the right of way?
2. If they do cover for the whole damage of my car, when can I expect to get my car back and can I choose my own mechanic to fix my vehicle?
3. Should I consider hiring an attorney for the worsening neck and back pain that Im having?
An immediate answer would really be helpful. Ive never been in a car accident and I have no idea of the insurance procedure.
